Terms

These Terms are a binding agreement between you and Voyagr Travel Communities Inc., a Delaware corporation at 251 Little Falls Drive, Wilmington, DE 19808, United States (“Voyagr”, “we”, “us”). They govern your use of the Voyagr mobile application and any related services (the “Service”).
Please read §13 (Disclaimers), §14 (Meeting other users), §15 (Limitation of liability), and §18 (Arbitration and class action waiver). They limit our liability and affect how disputes are resolved.
By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
1. Eligibility
You must be 18 years of age or older to use Voyagr. By using the Service you represent that you are 18+, that you have the legal capacity to enter this agreement, that you are not barred from using the Service under the laws of your country or the United States, that you are not on any government prohibited-party list, and that you have never been convicted of a felony, a sex offense, or any crime of violence, and are not required to register as a sex offender with any authority.
We may terminate any account that does not meet these requirements, at any time, without notice.
2. Your account
One person, one account. Do not create an account for anyone else or transfer yours to anyone.
The information you provide must be accurate — particularly your name, age, and photos. Photos must be of you.
You are responsible for keeping your password secure and for everything that happens under your account. Tell us immediately at hello@appvoyagr.com if you suspect unauthorized access.
We may refuse, suspend, or terminate an account at our discretion, including for the reasons in §7.
3. Licence to use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Service on a device you own or control, for your own non-commercial use. That licence ends when your account ends.
You may not: reverse engineer, decompile, or attempt to derive source code from the app; scrape, crawl, harvest, or bulk-collect any user’s data or photos by any means, automated or manual; access the Service by any automated agent, bot, or non-official client; copy, frame, mirror, or resell any part of the Service; attempt to bypass row-level security, rate limits, authentication, or any other technical restriction; use the Service to build a competing product or dataset; or remove any proprietary notice.
4. Your content
You keep ownership of everything you post — your photos, bio, messages, and every other piece of content you create (“Your Content”).
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and resizing only), and display Your Content solely for the purpose of operating and providing the Service to the audience you have chosen — your clubmates, your groups, the people you message. This licence exists so that we can technically show your photos to your clubmates; it is not a licence to market you. We will not use Your Content in advertising or promotional material without asking you first. The licence ends when you delete the content or your account, except for copies already made in routine backups, which expire on the schedule in our Privacy Policy.
You represent that you own or have the right to post Your Content, and that it does not infringe anyone’s rights or break any law.
We may remove content that violates these Terms or our Community Guidelines, with or without notice.
5. Clubs, join codes, and organizers
Voyagr is organized around clubs. Access to a club is by join code, which the club’s organizers control.
Joining a club makes your card visible to that club’s other members, and gives that club’s owner and board members access to your name, city, role, and join date, plus reports filed against you. This is set out in full in §4.2 of our Privacy Policy. If you are not comfortable with that, do not join the club.
Do not share a club’s join code with anyone the club has not authorized to receive it.
Club organizers may remove you from their club or change your role in it, for any reason consistent with these Terms and their own club rules. Removal ends your access to that club’s groups and members. It does not affect your Voyagr account or your other clubs. Removal decisions are the club’s, not ours — we provide the tool; the club decides. Take it up with them.
If you run a club, §6 also applies to you.
6. Additional terms for club organizers
If you create or administer a club, you additionally agree that:
You will use member data — the roster, aggregate statistics, and reports — only to run your club. You will not export it, sell it, market to it, or use it for any purpose unrelated to the club.
You will apply your moderation powers fairly and will not use removal or role changes to harass, retaliate against, or discriminate against members.
You will handle reports responsibly, will keep the identity of reporters confidential within your board, and will escalate anything involving threats, minors, or illegal activity to us at safety@appvoyagr.com rather than handling it yourself.
You are responsible for what your board members do with these powers.
If your club is affiliated with a school or institution, you are responsible for any additional obligations that institution imposes on you. Voyagr is not a party to that relationship.
You will comply with applicable data protection law in respect of member data you access. Where you determine the purposes of your own processing of that data, you act as an independent controller and are responsible for your own compliance.
We may revoke club organizer privileges at any time for breach of this section.
7. Acceptable use
Our Community Guidelines are incorporated into these Terms. In addition, you agree not to:
Impersonate anyone; post photos that are not of you; misstate your age.
Harass, threaten, stalk, intimidate, defame, or bully anyone.
Post hate speech, or attack anyone on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age.
Post sexually explicit content, nudity, or content sexualizing minors in any form.
Post violent, graphic, or self-harm content.
Solicit money, promote investments, run commercial promotions, recruit, or advertise.
Share anyone else’s personal information without their consent.
Use the Service for prostitution, trafficking, drug sales, or any other unlawful purpose.
Spam, phish, distribute malware, or attempt to compromise the Service or another user’s account.
Circumvent a block, a removal from a club, or a ban — including by making a new account.
Consequences. We may remove content, limit features, suspend, or permanently ban an account for any breach, at our discretion and without refund. Serious matters — threats of violence, sexual content involving minors, credible danger to someone — will be reported to law enforcement. Some breaches will get an account banned on the first instance and without warning.
8. Reporting and moderation
Report anyone from the ⋯ menu on their card. Reports go to your club’s organizers and, for serious matters, to us. We aim to review reports involving safety within 24 hours.
We are not obliged to act on every report, and we do not promise a particular outcome. Filing a knowingly false report is itself a breach of these Terms.
9. Paid features
The Service is currently free. We intend to introduce paid features — subscriptions or one-off purchases for individual members, and paid plans for clubs. When we do:
Prices and what’s included will be shown to you before you are charged. You will never be charged for something you did not affirmatively purchase.
Purchases made in the app are processed by Apple or Google, under their terms and payment methods. We do not receive or store your card details.
Subscriptions renew automatically at the then-current price until cancelled. You cancel through your Apple or Google account settings, at least 24 hours before the period ends. Deleting the app does not cancel a subscription.
Refunds for in-app purchases are handled by Apple or Google under their policies. Where consumer law gives you a statutory right to a refund or a cooling-off period — including the 14-day right of withdrawal for consumers in the EU and UK — that right applies and is not affected by anything in these Terms.
Club plans billed outside the app stores will be governed by a separate order form or agreement, which prevails over this section where they conflict.
Price changes will be notified at least 30 days ahead and will apply only from your next renewal. You may cancel before then.
We may change, limit, or withdraw paid features; if we withdraw one you have paid for, we will refund the unused portion pro rata.
Nothing in this section takes effect until we actually launch a paid feature and you buy it.
10. Third-party services
The Service is distributed through the Apple App Store and Google Play and relies on infrastructure from third parties. Their terms govern their own services. We are not responsible for third-party services, and links or references to them are not endorsements.
11. Intellectual property and copyright
The Voyagr name, logo, app design, and software are owned by us and protected by intellectual property law. These Terms grant you no rights in them.
Copyright complaints. If you believe content on Voyagr infringes your copyright, send a notice under 17 U.S.C. §512(c) to our designated agent at hello@appvoyagr.com including: your signature (physical or electronic); identification of the work; identification of the infringing material and where it is; your contact details; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. We will respond, and we terminate repeat infringers.
Counter-notices may be sent to the same address.
12. Suspension, termination, and your right to leave
You may delete your account at any time from Settings → Account. Deletion is immediate and irreversible; export your data first if you want it.
We may suspend or terminate your access at any time for breach of these Terms, for conduct that risks harm to other users or to us, if required by law, or if we discontinue the Service. Where reasonable and lawful, we will tell you why and — for EU and UK users — give you a route to contest it, by replying to the notice or writing to hello@appvoyagr.com.
Sections 4 (as to licences already granted), 11, 13, 14, 15, 16, 17, 18, and 19 survive termination.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT OR INFORMATION PROVIDED BY OTHER USERS IS ACCURATE.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. If you are a consumer in the EU or UK, nothing in these Terms excludes or limits your statutory rights, including the right to a service supplied with reasonable care and skill.
14. Meeting other users — please read this one
Voyagr introduces people who may then meet in person. That is the point of it. It is also the part we cannot control.
We do not conduct criminal background checks, identity verification, or any screening of users. Anyone can write anything on a profile.
You are solely responsible for your interactions with other users. We are not a party to them and have no duty to monitor them.
Take normal precautions: meet in public the first time, tell a friend where you are going, do not share your home address or financial information, do not send money to anyone you have met here, and leave any situation that feels wrong.
Never send money to another user. Requests for money, gift cards, crypto, or investment help are, in our experience, always a scam. Report them.
To the maximum extent permitted by law, we disclaim liability for the conduct of any user, online or offline.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOYAGR AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing here limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Consumers in the EU and UK retain all non-excludable statutory rights.
16. Indemnity
You agree to indemnify and hold harmless Voyagr and its officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or your violation of anyone’s rights. This does not apply to consumers to the extent prohibited by applicable consumer law.
17. Governing law
These Terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to §18, you and we submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
If you are a consumer resident in the EEA or the UK, this choice of law does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in your local courts.
18. Dispute resolution — arbitration and class action waiver
This section applies only to users resident in the United States. It does not apply to consumers in the EEA or the UK.
Talk to us first. Before starting any formal proceeding, email hello@appvoyagr.com describing the dispute. We will try in good faith to resolve it within 60 days. Most things end here.
Arbitration. If we cannot resolve it, you and we agree that any dispute will be resolved by binding individual arbitration administered by JAMS under its consumer rules, before a single arbitrator, in Delaware or — at your election — remotely or in your home county. The Federal Arbitration Act governs. This means you and we are waiving the right to a trial by jury.
No class actions. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative action. If this paragraph is held unenforceable, the whole of §18 is void.
Exceptions. Either party may bring an individual claim in small-claims court, and either may seek injunctive relief in court for infringement or misuse of intellectual property.
Opt out. You may opt out of this entire section by emailing hello@appvoyagr.com with your name and account email, with “Arbitration Opt-Out” in the subject line, within 30 days of first accepting these Terms. Opting out costs you nothing and does not affect anything else.
19. Apple-specific terms
If you downloaded the app from the Apple App Store, this section applies and prevails over anything inconsistent:
These Terms are between you and Voyagr only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to legal or regulatory requirements, and claims under consumer protection or privacy law.
If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and are not on any U.S. Government prohibited-party list.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You must comply with any applicable third-party terms of service when using the app.
20. General
Changes. We may update these Terms. For material changes we will give notice in the app and by email at least 14 days before they take effect. Continuing to use the Service after that means you accept them. If you don’t, delete your account.
Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the whole agreement between us about the Service.
Severability. If any provision is unenforceable, the rest stands.
No waiver. Not enforcing a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
